Terms of Sale and Use

Welcome to Yaply. These terms govern your subscription and your use of the service. Please read them carefully before subscribing.

1. Purpose

These Terms of Sale and Use (the “Terms”) govern access to the Yaply Chrome extension and the paid subscription that unlocks it. Creating an account and making any payment constitute full acceptance of these Terms.

2. Publisher

Yaply is published by Matthias Marchione, sole trader (see the Legal Notice). Contact: contact@yaply.app.

3. Description of the service

Yaply is a Chrome browser extension that translates, at the user's request and on their own screen, the content they read or write on x.com (posts, replies, direct messages). The service requires an active subscription. Yaply is an independent tool, not affiliated with X Corp.

4. Account

Use requires an account, created at the time of payment. The user is responsible for keeping their credentials confidential and for all activity under their account. An account is strictly personal.

5. Price and payment

The subscription is billed at $9 per month or $90 per year (launch price locked for life while the subscription stays active; regular price $12/month). Prices are shown in US dollars, all taxes included. VAT not applicable, article 293 B of the French Tax Code (VAT exemption scheme). Payments are processed by our provider Stripe; Yaply never collects or stores any card data.

6. Subscription and renewal

The subscription runs for the chosen term (monthly or annual) and renews automatically at each term for an identical term, until cancellation. The amount is charged at each renewal via Stripe.

7. Right of withdrawal

The service provides immediate digital access. Under article L221-28, 13° of the French Consumer Code, by subscribing the user expressly requests immediate performance of the service and acknowledges waiving their fourteen (14) day right of withdrawal once the service has begun. This consent is collected before any payment.

8. Cancellation

The user may cancel at any time from their management area (Stripe portal). Cancellation takes effect at the end of the current period; access remains open until then. No pro-rata refund is issued for the period already started, unless required by law.

9. Availability and maintenance

Yaply uses reasonable means to keep the service available, without guaranteeing uninterrupted or error-free operation. The service may be temporarily suspended for maintenance. Translation relies on a third-party provider and automated models: translations may contain inaccuracies.

10. Acceptable use

The user agrees to use Yaply as intended and in accordance with X's terms of use. Reselling, sharing, abusively automating the service, circumventing usage limits, or using Yaply for unlawful purposes is prohibited. Yaply publishes nothing and acts on X only at the user's initiative.

11. Intellectual property

The extension, the Yaply brand, its logos and content are the property of their publisher. The subscription grants a personal, non-exclusive, non-transferable right of use. The user keeps ownership of the content they translate.

12. Liability

Yaply cannot be held liable for indirect damages, nor for the consequences of an automated translation, of X's unavailability, or of the translation provider. In any event, the publisher's liability is limited to the amount paid by the user over the last twelve (12) months.

13. Personal data

The processing of personal data is described in the Privacy Policy (yaply.app/privacy), which forms an integral part of these Terms.

14. Changes to the Terms

These Terms may be amended. Users are informed of any material change; continued use constitutes acceptance of the version in force.

15. Governing law, mediation and disputes

These Terms are governed by French law. In case of a dispute, the user first contacts contact@yaply.app for an amicable resolution. Under the French Consumer Code, a consumer may use a consumer mediator free of charge. They may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr. Failing agreement, the French courts have jurisdiction.
